1. CONCLUSION OF THE CONTRACT AND DELIVERIES

 

On the www.lokalconcept.com, contracts are exclusively concluded in English. 

 

To purchase an item, and thereby place an order, you will need to add the item to your shopping cart. You will be able to choose the amount of items you wish to order according to the availability. Then you will need to fill in your customer account details, choose the delivery and the payment method. You will then be able to verify the details of your order and, if necessary, correct any errors before placing your order. The main characteristics and the price of our products are indicated on the product pages containing the detailed description of our products. The "confirm order" button allows you to confirm your order which then becomes final, and a sales contract is thus concluded. We will confirm receipt of your order by email. Please note that the delivery of the products ordered is made against payment in advance (reservation) upon receipt of full payment of the sale price as well as the delivery costs in case applicable. 

 

We reserve the right to assign the claim corresponding to your purchase to third parties. 

 

In the event that an item you have ordered is unavailable, we will let you know as soon as we can and, where payment has already been made, make a refund to your payment method without undue delay. 

 

We will inform you about the expected delivery time on each product detail page as well as immediately by Email once you place an order. When the deadlines are expressed in working days, by working days we mean all the days between Monday and Friday inclusive, but not public holidays.

 

 

2. PRICES AND SHIPPING COSTS

All prices on the lokalconcept.com website are given in EUR. Subject to section 2.5 below, the prices given on the website on the date the order is placed shall apply. The stated prices are final prices (totals) and include added tax (BTW/TVA) at the applicable statutory rate. As detailed in 2.2 delivery charges can be added to your final order. All items remain our property or the property of the relevant Lokal partner, as the case may be, until full payment of the purchase price.

 

We deliver within Belgium, Netherlands, France and Luxembourg only. For Belgium orders of €100 or above there is no shipping charge. Orders of less than €50 shall incur a standard shipping charge of €5 including BTW/TVA. Orders of less than €100 and more than €50 shall incur a standard shipping charge of €3 including BTW/TVA. For the other three countries: Lokal charges €9 for orders till €100, 5€ for orders in between €100 and €250. Orders above €250 are free of shipping charges. Shipping costs accrue and are levied by Lokal.

 

Collection from store is possible for certain orders. When placing your order, you will see whether this option is available for your particular order as well as the costs of this option. Availability at our store will be confirmed immediately after your order confirmation. Collection is done at Lokal Store in Brussels at Rue des Eperonniers 18 during opening hours. Confirm on our website store address and opening hours.

3. PAYMENT

 

3.1 We accept the following payment methods: Bancontact and credit card. We reserve the right not to accept certain payment methods for a given order and to refer to other payment methods. You are responsible for any costs associated with money transactions.

4. RETURN

​

In case of wrong delivery, damaged or default products, you are entitled to return your purchase during a period of 10 calendar days, calculated from the day following the day on which you received the product from Lokal or its partner. During the above cancellation period, you have a duty to take reasonable care of the products and retain possession of them.

A product which you wish to return must satisfy the following conditions: 1. It must be in new condition. 2. It must be unworn, unwashed and undamaged. 3. It must be complete. 4. It must be packaged in a sufficiently sturdy box (we recommend the original box), so that we receive the product in an undamaged condition. All order cancellation requests may be sent to us by email (or contact us by phone if you do not have email).

If your returned package reaches us, in accordance with the conditions above, we will arrange for a refund within 14 calendar days. We reserve the right to only make a refund when the goods have reached us. All returns are paid by Lokal. You will receive a shipping label for your return by following the return instructions.

 

Please note that if you receive the product(s) before cancellation, you must return the product(s) to Lokal at your own cost to the address provided within 14 calendar days following the withdrawal or delivery, and we will not be responsible for any loss or damage that occurs in transit and, for this reason, we recommend that you use a recorded delivery service. If returned products are lost or damaged in transit, we reserve the right to charge and reclaim from you amounts related to such loss and or damage.

Where possible, products should be returned in or with their original packaging.

Lokal will give you a refund, consisting of the purchase price and delivery costs, where you cancel or return a cancelled product. Lokal will refund you within 14 days from the date on which we receive the returned products.

5. DISPUTES

 

These Terms, all transactions and any matters arising out of your use of the Website shall be governed by the law of Belgium and subject to the non-exclusive jurisdiction of the courts of Brussels.

6. LIABILITY

​

We will not be liable to you if we are prevented or delayed from complying with our obligations under these terms by anything you (or anyone acting on your behalf) does or fails to do or due to events which are beyond our reasonable control.

The aggregate liability of Lokal or you under these terms shall not exceed 100% of the price of the product(s) you have ordered from Lokal plus the cost of delivery of such product(s) to you.

7. INTELLECTUAL PROPERTY

 

You agree that all intellectual property rights (including, but not limited to trademarks, copyright, database rights, and any other intellectual property rights) in all material or content (including, but not limited to, logos, graphics, photographs, animations, videos, text, data compilation, and any combination of the foregoing) supplied or made available on this Website is held by Lokal and is protected by applicable laws throughout the world. You are only permitted to use this material/content as expressly authorised by us.
